1. CONFIDENTIALITY

Due to the nature and objectives of the services available on this website, it is mandatory that the user declares that he is over 18 (eighteen) years of age and that he has the legal capacity to do so. The user is required to provide contacts and/or information that may be considered of a personal nature. SANTOS & SEIXO WINES DISTRIBUIÇÃO, LDA undertakes to respect the legislation in force on the protection of personal data of its customers, in accordance with the Internal Legislation and the General Data Protection Regulation of the European Union.

2. CORRECTION AND UPDATE OF PERSONAL INFORMATION

All information provided by the user must be correct and true. The user must update the information provided, whenever it undergoes any changes. The user is solely responsible for any false, incomplete or incorrect statements that he makes and for the damage they may cause to the company or third parties. The user of this website is responsible for and the owner of the data that he transmits to SANTOS & SEIXO WINES DISTRIBUIÇÃO, LDA, being able to access, update or rectify the information provided about his data. The user can consult their orders, returns and communications with the company.

We further inform that SANTOS & SEIXO WINES DISTRIBUIÇÃO, LDA has appointed a data protection officer who will handle all requests arising from the processing of personal data. The product information displayed on the Site is only intended to provide a brief summary information for the visitor's best convenience and information. The photographs presented on the Site are for illustrative purposes only, and the user should consult detailed information about the products and their characteristics/specifications.

4. SHIPPING POLICY:

PRICE: The advertised price is in euros and includes VAT at the statutory rate. If there is a charge for postage, the respective cost will be clearly indicated. All products sold will be billed by AT-certified program.

TRANSPORTATION: The delivery service will be provided by entities outside SANTOS E SEIXO WINES – DISTRIBUIÇÃO, LDA, which were selected in order to guarantee a rigorous and quality service. When the User registers an order, the existing options for each order will be automatically displayed, indicating the amount to be paid and the expected delivery time.

DELIVERY TIME: For mainland Portugal, the average estimated time for delivery of the order is approximately 3-5 working days for products in stock. If the selected product is not available for immediate shipment, the customer will be informed of the new delivery date. This time is provided by the corresponding transport service provider and, under no circumstances, SANTOS E SEIXO WINES – DISTRIBUIÇÃO, LDA may be held responsible for any delay or advance verified against the estimated delivery time.

DELIVERY ADDRESS: Orders will be delivered to the address that the user indicated during the registration process on the Site or, if you have used this feature, to the address that was indicated as an alternative delivery address during the ordering process. Any permanent change of address will have to be made by the User updating their registration data. As already mentioned, SANTOS E SEIXO WINES – DISTRIBUIÇÃO, LDA will not be liable for damages caused by the existence of incorrect data in the User's file.

SANTOS E SEIXO WINES – DISTRIBUIÇÃO, LDA always recommends choosing a delivery address where someone is to receive the order during normal working hours.

NAVIGATION ON THE WEBSITE: The user can freely browse the Website even without being registered on the Website and, by doing so, does not incur any obligation to place an order. However, the User can make the purchase without the need to register in the customer area.

REGISTRATION: To register an order, the user will have to add the desired items to the shopping cart, with the possibility to remove or change the selected items. After selecting the items, choose the option “Checkout”. In the next step you will enter the delivery data (name, email, telephone, address, postal code and location) or log in to your customer area. Next, you'll have to choose the delivery method, which will automatically calculate the shipping costs and method of payment, and you'll also be able to enter any voucher you have in your possession.

PAYMENT: The payment methods available are: Bank Transfer, ATM Reference, visa, mastercard and mbway.

FINALIZATION: Before finalizing the order by selecting the payment option, you must confirm all data, and you can go back and modify your order, payment or delivery method. After finalizing the order, it becomes definitive and it is not possible to change it. The User will immediately receive an email confirming the order registration and showing their details. The order will be filed by SANTOS E SEIXO WINES – DISTRIBUIÇÃO, LDA, computerically and/or physically for the simple purpose of recording the orders placed and their processing. This order serves as proof of the contractual relationship of purchase and sale established between the user and SANTOS E SEIXO WINES – DISTRIBUIÇÃO, LDA.

If payment is made via Mbway or credit/debit card and after this payment is made, the order will be registered and confirmed in our system immediately. If you choose to pay via Bank Transfer or Multibanco Reference, you will receive an email with the aforementioned data, however the order will only be registered and confirmed in our system after we receive confirmation of payment.

Upon receipt, a payment receipt will automatically be sent.

CONFIRMATION: All orders will be confirmed by SANTOS E SEIXO WINES – DISTRIBUIÇÃO, LDA by sending an email that will reflect the expected delivery time and shipping data. In the event of a stockout, SANTOS E SEIXO WINES – DISTRIBUIÇÃO, LDA will contact the user indicating the expected delivery date of the missing item(s).

5. RETURN POLICY

Change and/or Cancellation: The user may cancel or change his order within a maximum period of 4 (four) hours, by email to comercial@santoseseixo.pt or by telephone to (+351) 218 222 308.

Return: Upon receipt of the order, the User has a period of 14 days to resolve the purchase and sale agreement entered into on the Website (total or partial return of the order), and to do so, notify SANTOS E SEIXO WINES – DISTRIBUIÇÃO, LDA through an email to comercial@santoseseixo.pt

RETURN PROCEDURE: The user must send the items he wishes to return to SANTOS E SEIXO WINES – DISTRIBUIÇÃO, LDA, considering the following address: Rua Professor Henrique de Barros, nº4,1ºA –Edifício Sagres 2685-338 Prior Velho, Lisbon, Portugal.

The exercise of the right of withdrawal (return of articles) must comply with the following conditions:

• Return of articles in proper conditions of use;
• Return of items with all labels, including price or bar code;
• Return of items in the original packaging in perfect condition;
• Return of unused items;
• The products must be returned within a maximum period of 14 (fourteen) days from the date of receipt of the order, accompanied by the respective proof of purchase;
• The costs with returns, except in cases duly recognized by SANTOS E SEIXO WINES – DISTRIBUIÇÃO, LDA, will always be borne by the User. That is, the value of postage and fees paid by the User upon receipt of the order and the amount you have to pay to return it.
  Indicate to SANTOS E SEIXO WINES – DISTRIBUIÇÃO, LDA which method you want to choose to settle your return.

RETURN modalities:

1 - Return for Exchange for Another Item: If, when making a return, the user wants to exchange the items returned for other items, he must mention this when he communicates the intention to return, clearly indicating which items he wants to receive in exchange. In this case, in addition to supporting the initial shipping costs for the order and return, the user will also have to pay the shipping costs for new items.

In case the value of the returned items is different from the value of the items intended for exchange, the differences will be rectified as follows: if the returned items are of a lower value than those requested in exchange, the user must pay the difference, if this value is higher than that of the items requested in exchange, the user can choose to return the difference by choosing to issue a voucher or a refund.

2 – Refund: The user may request a refund corresponding to the value of the returned items. In this case, SANTOS E SEIXO WINES - DISTRIBUIÇÃO, LDA undertakes to refund the amount, subject to the appropriate adjustments, when applicable, using the same means by which the payment was made whenever possible and within a maximum period of 30 days from the receipt of the articles.

Whenever the return of one or more items, which have been purchased at a discount based on the purchase price, implies that the minimum purchase price limit for granting this discount is no longer met, the refundable amount will be adjusted proportionally depending on the amount that was actually paid.

SANTOS E SEIXO WINES – DISTRIBUIÇÃO, LDA, reserves the right to change these Terms and Conditions without prior notice. The user is bound by the version of the Terms and Conditions at the time of use, so we recommend that you consult them.

6. INTELLECTUAL PROPERTY: Unless otherwise stated, the contents of the Site, text, graphics, photographs are copyrighted to the company, and their use, for commercial purposes or not, is prohibited.

7. LIMITATION OF LIABILITY: The user will be responsible for the content of the information sent or transmitted to the Site. The User is aware that the use of the Site may not be 100% secure, with the possibility that the information sent/received may be intercepted by unauthorized parties, and the company is not responsible for failures in the security of communications and assumes no responsibility for the use improper use of your information by third parties.

The user acknowledges that access to and use of the Site may be interrupted and that the information on the Site may contain bugs, errors, technical failures, problems or other limitations. The Site may contain links to other electronic pages or be accessed through other electronic pages. The company cannot be held responsible for them, namely for the control of content, availability, operability or performance.

To the maximum extent permitted by law, the company excludes any liability, direct or indirect, for the use of the Site.

8. FINAL PROVISIONS: In case of violation of these Terms and Conditions, we reserve the right to take any and all actions legally provided for. In addition, we reserve the right, at our discretion, to terminate access to or use of the Site, with or without notice to the User. The Terms and Conditions of use of the Site are regulated in accordance with the laws in force. If any provision described herein is found to be illegal, void, or for any reason unenforceable, that provision will be eliminated or reduced by law, not affecting the validity and enforceability of the remaining provisions.

We reserve the right to change these Terms and Conditions without prior notice. The User is bound by the version of the Terms and Conditions at the time of use, so we recommend that you consult them periodically.
